Personal Items excluded from contract?

Agent: "My buyer just closed on their home. The contract stated turnkey furnished excluding personal property. When they arrived, a huge painting, the dining room table, exercise equipment, grandfather clock, several tools and a compressor were all removed from the home. The buyer is furious and expects me to handle it. Either return everything or get $5,000.00 for damages. When I spoke to the listing agent they responded by saying those were all personal items or had sentimental value. Buyers have now contacted an attorney who is going to charge them accordingly. They just asked me how much I am willing to throw in. What? This isn't my problem!!!! Help!!!"

Broker: "Oh it could become your problem if the attorney decides you're part of the problem. Anytime you see personal items addressed in a contract, ask for a list because what is personal to one person may not be personal to another. (We aren't talking about tooth brushes.) This is a very common issue and many times the agent ends up kicking money into the deal just to preserve their relationship with the buyer. There isn't much you can do if the seller digs their heels in. I will talk to the other broker but don't hold out much hope. Next time itemize !!!!!!"
